§ 171-13. Deposit on
streets and sidewalks prohibited.
No person,
firm, corporation, their agent, or their employee shall deposit, place, or
strew snow, nor shall any person, firm, corporation, their agent, or their
employee cause to be deposited, placed, or strewn any snow or ice upon any
sidewalk, street, avenue, or roadway within the Village of New York Mills.
§ 171-14. Plowing snow
across Village streets.
No person, firm,
corporation, their agent, or their employee shall plow snow across a Village
street, causing snow to be deposited onto a Village right-of-way or causing a
hazard to the public.
§ 171-15. Moving snow
to another parcel of real estate.
No person,
firm, corporation, their agent, their employee, or occupant shall remove snow
or ice from any parcel of real estate and place it upon another parcel of real
estate without the express permission of the owner of the parcel of real estate
upon which the snow or ice is to be placed.
§ 171-16. Snow and ice
falling from buildings.
The owners
or occupants of buildings adjacent to public sidewalks shall take measures to
protect the public from the falling snow, ice, or water from such
buildings.
§ 171-17. Removal of
snow and ice from sidewalks.
The owner or
occupant of a parcel of real estate who has placed or caused to be placed snow
or ice unlawfully upon any sidewalk must remove the snow or ice within four
hours after official notice by the Village Highway Superintendent, Village
Codes Officer, or Village police officer. If the snow or ice has not been
removed within the four hours, it shall be the duty of the Village Highway
Superintendent to remove said snow or ice from such sidewalk and notify the
Village Clerk of the expense incurred by the amount of labor, equipment, and
materials used. The charge shall not be less than the equivalent of one hour's
wage for the highest paid hourly Village Highway Department employee.
§ 171-18. Reimbursement
of costs to Village.
The Village
Clerk shall promptly present to the owner or occupant of each parcel a bill for
the removal of snow and ice as certified by the Village Highway Superintendent.
If not paid within 30 days, the cost thereof shall be assessed against the
property, added to their tax bill and become a lien thereon, collectible in the
same manner as delinquent taxes.
§ 171-19. Penalties for
offenses.
Any person,
firm, corporation, their agent, or their employee who shall violate
§ 171-13, 171-14 or 171-15 of this article shall, upon conviction, be
subject to a fine of not more than $250, imprisonment for not more than 15
days, or both such fine and imprisonment, for each offense. Each day that a
violation continues shall be considered a separate offense.
