April 10, 2007: Regular Board Meeting

Body:
 

Mayor Maciol called the meeting to order at 7 PM followed by the pledge to the flag and roll call.

Present:  Mayor Maciol, Trustee Bialek, Trustee Jarosz, and Trustee Semeniak

Absent:  Trustee White

Also Present: Police Chief Frankland, Highway Supt. Cotrupe, Codes Officer Neary, Village Engineer Al Swierczek, village residents Bob Pettigrew, Frank Furgal and Marty Toczydlowski.

 

PUBLIC HEARING

Trustee Bialek made a motion seconded by Trustee Jarosz to open the public hearing at 7:02 PM for Local Law #2 for 2007 - Amend Chapter 194 - "Vehicle & Traffic" add to section 194.10 - No Parking on the south side of Parkside Ct from Glod to the dead end.

Mayor Maciol read the public notice and asked for comments;

Bob Pettigrew - Parkside Ct - in favor of the no parking but we need to look at other dead end streets in the village and do the same.

Frank Fugal - Parkside Ct - in favor - but needs to make sure the signs aren't pulled out like they have in the past on Glod Ave from Parkside to Chestnut.

Marty Toczydlowski - Parkside Ct - in favor - concerned with emergency traffic getting through.

Board members are also in favor of the no parking signs.

Trustee Semeniak made a motion seconded by Trustee Bialek to close the public hearing at 7:22 PM.

Trustee Jarosz made a motion seconded by Trustee Bialek to approve Local Law #2 for 2007 - "Vehicle & Traffic" add to section 194.10 - No Parking on the south side of Parkside Ct from Glod to the dead end.

REGULAR BUSINESS

Trustee Semeniak made a motion seconded by Trustee Jarosz to accept Abstract #11 as presented: General vouchers A648-A710 in the amount of $73,549.13 and Library vouchers L101-L115 in the amount of $5,602.04 for a total of $79,151.17.

 

Trustee Semeniak made a motion seconded by Trustee Bialek to accept the Treasurers report for March as presented.  March check numbers: payroll 5904-5998, general 10651-10719.

 

Trustee Semeniak made a motion seconded by Trustee Jarosz to accept the minutes of the March 13th meeting as presented.

 

Trustee Semeniak made a motion seconded by Trustee Jarosz to accept the minutes of the April 2nd Annual Organizational Meeting as presented.

 

Recreation - Mayor gave report in Trustee White's absence.  Report is on file in the Clerk's office. We are looking into an Intermunicipal Agreement with Yorkville for the summer park program. 

 

Police - Chief gave his report, which is on file in the Clerk's office.  DARE Graduation will be April 25th at 6:30 at NYM School.

Trustee Semeniak made a motion seconded by Trustee Jarosz to accept the Police report as presented.

 

Highway - Joe gave his report, which is on file in the Clerk's office.  He ordered hopefully the last delivery of salt for this season for storm coming this week.

Trustee Bialek made a motion seconded by Trustee Semeniak to accept the Highway report as presented.

 

Fire Department - Trustee Bialek reported we filed and insurance claim on Truck 1.  We had a breakdown in the tone relays on the fire horn this weekend; Chief is looking into getting it fixed.  We are selling surplus old equipment in the firehouse.  We have already sold $200 worth.  Chief will take the rest of the surplus equipment to a flea market in New Jersey.

Town of Whitestown fire contract is approximately $114,000 but we have not received a written contract yet.

 

Code Enforcement - Dave gave his report, which is on file in the Clerk's office.  He has completed his annual codes training.  Dave spoke to Mr. Robinson regarding his burnt house on Cottage Street, he has people looking at it to purchase, and if it doesn't sell he will demolish it.  Also spoke to Gary David and sent his construction company a letter suggesting that a Department of Labor AV-106 Variance be granted for the property.

Wrobilcki property on Main Street is in the attorney's hands.

Trustee Jarosz made a motion seconded by trustee Bialek to accept the Codes report as presented.

 

Engineer - Al gave his report, which is on file in the Clerk's office.

  1. Al discussed the drainage system discharge, which the DEC mandates that each MS4 adopt an ordinance regulating substances, which can be discharged to storm drainage system.  Trustee Semeniak made a motion seconded by Trustee Bialek to hold a public hearing May 8th at 7 PM for Local Law #3 for 2007 - Drainage System Discharge.
  2. Al discussed the stormwater management ordinance.  He met with the Planning Board regarding implementing of the DEC mandated stormwater to review the criteria in site plan review process.  Draft local laws were reviewed and accepting by the Planning Board.  Presenting them to the Village Board as Local Law #4 for 2007 - Stormwater Management & Erosion control, Local Law #5 for 2007 - Subdivision of Land, and Local Law #6 for 2007 -Zoning.  Trustee Jarosz made a motion seconded by Trustee Semeniak to hold a public hearing May 8th at 7:15 PM for Local Laws 4, 5 & 6 for 2007.
  3. With the MS4 in its 4th year of a 5 year period, our annual report needs to be prepared and submitted to DEC on or before June 1st. A public hearing is required to present the report to the board and solicit public comment.  Trustee Bialek made a motion seconded by Trustee Jarosz to hold a public hearing May 8th at 7:30 PM for our MS4 Annual report.
  4. Checking into the Henderson Street sanitary backup problem. Received a letter from the DEC regarding the backup problem.  Working on a flow management plan to submit to the DEC within 30 days, Mayor wrote and asked for an extension.  Would like to have a workshop to discuss our options.  Workshop is scheduled for Monday April 16th at 6:30 PM.

 

Attorney - Bill is on vacation.

 

NEW BUSINESS

Appoint Summer Bus Driver - Trustee Jarosz made a motion seconded by Trustee Bialek to appoint Barbara Thomas as our summer parks bus driver.

 

Intermunicipal Park Agreement with Yorkville - Trustee Bialek is concerned with the liability issues, Trustee Semeniak is good with this.  Please read over to discuss next month.

 

Council of Villages - meeting Wednesday April 11th at 6:30 PM in Whitesboro.

 

Mayor Zurek thank you - for dish garden after surgery.

 

Police Officer Resignation - Trustee Semeniak made a motion seconded by Trustee Bialek to accept the resignation of part time police officer Ronald Rudwall effective April 9th, 2007.

 

Sampson Family Presentation - would like to present the village a flag in memory of their son who was killed in the line of duty.  A possibility is to put the flag on display in the new Community Center.  More discussion to follow.

 

OLD BUSINESS

Outdoor Multi-Fuel Furnace Local Law - board was presented a local law regarding outdoor furnaces by the Planning Board.  Trustee Bialek made a motion seconded by Trustee Semeniak to hold a public hearing May 8th at 7:45 PM on Local Law #7 for 2007 - Outdoor Multi-Fuel Furnaces.

 

TRUSTEE BUSINESS

Trustee Bialek - nothing

Trustee Jarosz - Fire Chief is getting a quote for a service contract on the generator.

Trustee Semeniak - nothing

 

Trustee Jarosz made a motion seconded by Trustee Bialek to adjourn the meeting.  Mayor Maciol adjourned the meeting at 8:25 PM.

 

Trustee Bialek made a motion seconded by Trustee Semeniak to enter into executive session t 8:25 PM to discuss a labor union issue.

 

Trustee Jarosz made a motion seconded by Trustee Bialek to adjourn the executive session at 8:37 PM.  No action taken.
