May 08, 2007: Regular Board Meeting

Mayor Maciol called the regular board meeting to order at 7:02 PM followed by the pledge to the flag and roll call.

Present:  Mayor Maciol, Trustee Baryla-White, Trustee Bialek, and Trustee Jarosz

Absent:  Trustee Semeniak

Also present: Highway Supt. Joe Cotrupe, Police Chief Frankland, Village Engineer Al Swierczek, Village Attorney William Borrill, Codes Enforcement Officer Dave Neary, Recreation Director Tammy Fisher, Planning Board Chairman John Meagher, Planning Board Member John Montrose, Marty T, and Doreen Czupryna.

 

Public Hearing on Local Law #3 for 2007 - Drainage System Discharges

Trustee White made a motion seconded by Trustee Jarosz to open the public hearing at 7:04 PM.  Mayor read the legal notice that was published in the OD.  Village Engineer Al Swierczek explained what the local law is about and why it is needed.  Mayor stated that the Planning Board has reviewed the material and recommends its adoption.  Village Attorney is ok with it.  No one wanted to comment on the law.  Trustee White made a motion seconded by Trustee Jarosz to close the public hearing at 7:08 PM.

Trustee Jarosz made a motion seconded by Trustee White to adopt Local Law #3 for 2007 -

Public Hearing on Local Laws #4, #5, and #6 for 2007 -

#4 - Stormwater Management & Erosion Control

Trustee White made a motion seconded by Trustee Jarosz to open the public hearing at 7:09 PM.  Mayor read the legal notice that was published in the OD.  Village Engineer Al Swierczek explained the local laws and why there are needed. Mayor stated that the Planning Board has reviewed the material and recommends its adoption.  Village Attorney is ok with it. No one wanted to comment on the laws.  Trustee White made a motion seconded by Trustee Jarosz to close the public hearing at 7:19 PM. 

Trustee Jarosz made a motion seconded by Trustee White to adopt local law #4 for 2007.

Public Hearing on MS4 Annual Report

Trustee White made a motion seconded by Trustee Jarosz to open the public hearing at 7:20 PM.  Mayor read the legal notice that was published in the OD.  Al explained the MS4 Annual Report for 2006. We received no written comments or no verbal comments.  Trustee White made a motion seconded by Trustee Jarosz to close the public hearing at 7:28 PM.

Trustee Jarosz made a motion seconded by Trustee White to adopt the 2006 MS4 Annual Report and to give the Mayor approval to sign the report.

 

Public Hearing on Local Law #7 for 2007 - Outdoor Multi-Fuel Furnaces

Trustee White made a motion seconded by Trustee Jarosz to open the public hearing at 7:30 PM.  Mayor read the legal notice that was published in the OD and explained the local law.  The Planning Board has reviewed and made changes before submitting to the board with recommendations to approve.  No one commented.  Trustee White made a motion seconded by Trustee Jarosz to close the public hearing at 7:32 PM.

REGULAR BUSINESS

Abstract #12 - On the 2006 Paving Contract modifications/adjustments to the contract were made with a change work order.  Trustee White made a motion seconded by Trustee Bialek to accept the change order and allow Mayor to sign off on the contract. Trustee Bialek questioned voucher A711 in which he is concerned with the computer purchases and stated we need to keep to our procedures.

Trustee Jarosz made a motion seconded by Trustee White to accept Abstract #12 - general vouchers A711-A758 in the amount of $110,490.72 and Library vouchers L116-L124 in the amount of $3,535.38 for a total of $114,026.10.

 

Trustee White made a motion seconded by Trustee Jarosz to accept the Treasurer's report as presented.  Check numbers for April were payroll - 5999-6070, general - 10723-10803.

 

Trustee White made a motion seconded by Trustee Jarosz to approve the minutes of the April 10th meeting.

 

Trustee Jarosz made a motion seconded by Trustee White to approve the minutes of the April 16th special meeting.

 

Trustee Jarosz made a motion seconded by Trustee White to approve the minutes of the May 1st special meeting.

 

DEPARTMENTS

Recreation - Tammy gave her report, which is on file in the Clerk's office.  Trustee White made a motion seconded by Trustee Bialek to accept the resignation of Virginia Vanderpool as summer park attendant.  Trustee White made a motion seconded by Trustee Jarosz to change part attendant Anna Moskal from part time to full time.  Will conduct interviews for the part time position.

Next Bell Festival meeting will be Tuesday May 29th at 6:30pm. Village wide Garage Sales will be July 6th and 7th, with the parade on July 7th at 5 pm.

Trustee Jarosz made a motion seconded by Trustee White to accept the Parks report.

 

Police - Chief Frankland gave his report, which is on file in the Clerk's office.  Chief received a letter of thanks from Oneida County DWI regarding Traffic Safety. DARE Graduation was held April 25th with a nice ceremony.  The family of Deacon John acknowledged Officer Toomey for his efforts in trying to save him.  Officer Toomey received a thank you from the Village of Whitesboro for catching the burglar that broke into an elderly woman's home.  Mayor authorized the Chief to order the police cars and tasers as the 2007/2008 budget allows for.

Trustee White made a motion seconded by Trustee Bialek to approve the Police report.

 

Highway - Joe gave his report, which is on file in the Clerk's office.  Received the new Ferris mower from Clinton Tractor for the 2007/2008 budget on state contract.

Trustee Jarosz made a motion seconded by Trustee White to enter into executive session to discuss the highway summer applicants at 8:35 pm.

Trustee Jarosz made a motion seconded by Trustee Whtie to close executive session at 8:50 pm.

Trustee Jarosz and Joe will get together and see what the availability of the applicants is and bring that information back to the end of year meeting.

The trees at 48 Greenman Ave need to come down -it is our tree, will also look into 39 and 43 Clinton Street to see the condition on the sidewalk from the trees.  We have safety issues with the tree at the Little League field by the concession stand that has wires going through it.  Need to look into the crack in the cement at 25 Porter Street from the sidewalk plow.

Trustee White made a motion seconded by Trustee Bialek to approve the Highway report.

 

Fire Department - Trustee Bialek reported Truck 1 has been fixed and the insurance claim was filed.  The Fire Department purchased turnout gear in the amount of $13,000, Mayor will acknowledge and thank them. The key situation was discussed, Mayor will look into.  Trustee Bialek made a motion seconded by Trustee Jarosz to accept Larry Mitsler's letter of resignation as Captain of Engine 2 and the appointment of Mike Edwards to fill the vacancy. Received the Town of New Hartford Fire Contract, looks ok.  The new fire horn should be here soon.

 

Code Enforcement - Demolition on Gary David's house should be done by Memorial Day.  Multiple inspections will start in June.

Trustee Whtie made a motion seconded by Trustee Jarosz to approve the Codes report.

 

Engineer - Al discussed the flow management plan along with the Emergency Action Plan.  Trustee White made a motion seconded by Trustee Bialek to approve the flow management and emergency action plans as presented in draft form.  Al will get the final forms for the Mayor to sign.

Al will get the televising inspection lined up for Henderson Street area. Al presented Option A for paving but needs to take sidewalks out due to our sidewalk reimbursement program and instead add to the curbing and handicap ramp amount. He will put together bid specifications for Main Street - Square to the village line, paving cut on Country Club and storm sewers on Pleasant and Garden.

 

Attorney - Bill is working on the intermunicipal agreements for Yorkville regarding the parks program.  Received further paperwork regarding the grievance on Burrstone Apartments.

 

NEW BUSIENSS

Edge Empire Zone - Peter Zawko from the Oneida County Empire Zone was present to explain the expansion of Oriskany Manufacturing at 2 Wurz Ave.  They would like to be included in the Empire Zone and fit the specifications, one of which is to add employment to the area. They are looking for a resolution of support and concurrence with the Oneida County Empire Zone with our approval.

Village Engineer Al Swierczek has some questions on the SEQR:

•1)      Our board would declare itself lead agency;

•2)      Need a coordinated review;

•3)      Review the material;

•4)      Need a public hearing on the SEQR.

 

Trustee Jarosz made a motion seconded by Trustee White to make us lead agency with the SEQR review.

Trustee White made a motion to accept the resolution of support and concurrence with the Oneida County Empire Zone.

Trustee White made a motion seconded by Trustee Jarosz to hold a public hearing on June 12th at 7 PM on the SEQR review and comments.

 

End-Of-Year Meeting - Trustee White made a motion seconded by Trustee Bialek to hold the End-of-Year meeting on Tuesday May 29th at 7 PM.

 

Highway Summer Help - Trustee Jarosz and Joe will interview applicants to see who is available and what times they are available to work and bring the information back to the end-of-year meeting.

 

Fireworks Contract - Trustee Bialek made a motion seconded by Trustee White to allow the Mayor to sign the Fire Works contract for July 7th.

 

Park Fence Request - is has been brought to our attention that the residents at 10 White Street would like a fence barrier between their property and the park.  After much discussion, the situation will be looked into further.

 

Diabetes Run Request - Trustee White made a motion seconded by Trustee Jarosz to allow the Diabetes run to come through the village on Saturday September 29th starting at 10 AM.  Fire Department will have EMT's on hand and the Police will have one officer designated for the run.

 

NYRI Meeting - will be held at the town of Paris Town Hall May 23rd at 7 PM.  The state is banning the wire to come through.

 

Memorial Day Parade - will be Monday May 28th at 11 AM.  Trustee Jarosz made a motion seconded by Trustee White to allow the parade to take place through the village.

 

MAYOR BUSINESS

NIMS Conference scheduled in Deerfield for May 24th from 6-9 PM at SUNY IT regarding an emergency response plan.

Defensive Driving in Yorkville in May - if anyone needs to go.

Sauquoit Creek Clean up on April 28th from McCraiths to Clinton Street went well.

Brian Thomas has applied for a Fire Department grant.

 

TRUSTEE BUSINESS

Trustee Baryla-Whtie - need to get rid of the old pots/plants in the park office.

Trustee Bialek -nothing

Trustee Jarosz - nothing

 

Trustee Bialek made a motion seconded by trustee White to adjourn the meeting.  Mayor Maciol adjourned the meeting at 10:14 PM

Trustee Bialek made a motion seconded by Trustee White to enter into executive session to discuss labor union negotiations at 10:15 PM.

Trustee Jarosz made a motion seconded by Trustee White to close executive session at 10:45 PM.
