Mayor Maciol called the regular board meeting to order at 7 PM followed by the pledge to the flag and roll call.
Present: Mayor Maciol, Trustee Bialek, Trustee Jarosz, Trustee McCoy and Trustee Semeniak
Also present: Highway Supt. Joe Cotrupe, Village Engineer Al Swierczek, Codes Officer Dave Neary, Planning Board Chairman and Assessor John Meagher, and Planning Board Member John Montrose.
Abstract # 3 discussion: Discussion on 2% Fire Department money purchasing turnout gear.
Codes Officer Neary stated OSHA regulations state all members must be provided with gear.
Trustee Semeniak questioned a Fire Department bill asking if it was brought to the board for approval before purchase was made.
Trustee Semeniak made a motion seconded by Trustee Jarosz to accept Abstract #3; General vouchers A124-A183 in the amount of $151,600.62, Library vouchers L027-L037 in the amount of $4,767.74 for a total of $156,368.36.
Trustee Semeniak made a motion seconded by Trustee Bialek to accept the June Treasurers report as presented.
Trustee Semeniak made a motion seconded by Trustee Jarosz to accept the July Treasurers report as presented.

Trustee McCoy made a motion seconded by Trustee Semeniak to approve the minutes from the July 8th meeting.
Recreation - Trustee McCoy reported the attendance from this summer's park program was very good. They had between 20-30 children on the trips. The Library program had a good response also. The parks close August 15th. Trustee McCoy acknowledged Stephanie Pett for the wonderful job she did with the Parks program this year.
Police - Chief Frankland is on vacation, his written report is on file in the Clerk's office. Trustee Semeniak made a motion seconded by Trustee Bialek to accept the written report. Trustee Bialek reported that he hooked up the second computer for the track program today.
Highway - Joe Cotrupe gave his report which is on file in the Clerk office. Mayor reported the ADA chips will be delivered tomorrow for the park equipment. Trustee Bialek will look into white sand for the slide area and swings. Trustee Semeniak made a motion seconded by Trustee McCoy to accept the Highway report.
Fire Department - the lights on the 2001 Engine 1 have been replaced; will check warranty to see if they are covered. The lights melted the lenses.
Code Enforcement - Dave gave his report which is on file in the Clerk's office. Dave will be on vacation August 15th to August 25th. He will see if Phil Husted and Tom Rowlands can cover.
Dave has questions on a building permit application he received from Oriskany Manufacturing; he will speak to the Village Attorney.
Trustee McCoy asked for an update on the black top still at the cal-da-sac on Clinton Street. Dave will call the owner again.
Trustee McCoy made a motion seconded by Trustee Jarosz to approve the Codes report.
Dave would like to commend Officer Toomey for helping with a medical call Sunday at St Mary's church.
Engineer - Al gave his report stating the 2008 paving should start in about two weeks; they have until September 22nd to complete.
National Water Main Cleaning Co's crew is still waiting for National Grid's structural repair of the grounding rod that was driven through the top of the Village sewer.
During heavy rains on Monday August 11th, Al received a report that a sanitary manhole cover had been opened in the parking lot of Nice-N-Easy at Henderson & NYS Route 5A, and was being used to drain low spots in the pavement. He spoke to the managers of Pappa Pardi Pizza Pub and Nice-N-Easy, informing them the activity was illegal and requested they cease it. Both were unaware it was and indicated they would stop. Will follow up on the situation.

Assistant Clerk Position - Mayor requested executive session to discuss.
Fire Department Request - Resolution 81-2008 - Trustee Jarosz made a motion seconded by Trustee McCoy to approve the purchase of the following items which are included in this year's budget:
•· Gear grid Wall Mount Lockers at $1,596.60.
•· 1 - 4 point deluxe package with space saver lifting struts & space saver adjustable stands at $5,220.00.
Fall NYCOM Conference - Lake Placid September 15th to 19th. Let Clerk know if interested in going.
Budget Seminar - August 25th at SUNY IT 7 to 9 PM.
Community Center Acoustics - Mayor received an estimate from Professional Technologies:
Materials - 3,700.00, Labor - 2,081.00 for a total of $5,781.00. This is not a budget item in this year's budget. The Seniors are willing to contribute $2,000.00 towards this project.
Trustee Semeniak suggested looking into a grant, possible the Community Foundation.
Trustee Bialek will see what he can find out from other places - doesn't feel it is a priority - need to research and apply for grants.
Trustee Jarosz - why wasn't this part of the original design?
New Fire Department Member - Resolution 82-2008 - Trustee Bialek made a motion seconded by Trustee Jarosz to approve the probationary membership of Jon Hadden and Joseph Spost.
Veteran's Exemption Refund - Mayor explained that an error with a veteran's exemption occurred where they were charged more instead of less for village tax this year. Resolution 83-2008 - Trustee Jarosz made a motion seconded by Trustee Bialek to refund Stanley Kurdzioloek of 69 Clinton Street the amount of $130.77 pending approval and recalculation by the Village Assessor.
Curb Cut - Resolution 84-2008 - Trustee Jarosz made a motion seconded by Trustee Bialek to approve the request from Gary Worosylo for a curb cut at 47 New Hartford Street.
207 C Conference - Trustee Semeniak attended this conference. He asked the board to read all the information he provided and stated we should have a plan in process. This conference concerns the disability procedures for Police Officers injured in the line of duty - 207C - to pay salary during the course of injury.
Oneida County Planning - We received a Greenway Plan for Mohawk River Corridor - which is on file for anyone to read.
NYRI Update - Mayor asked Codes Officer Neary to read the information after vacation and meet with the Village Attorney.
Sitrin Project - still waiting for final appraisal.
Questions: Would there be a second building on the site - NO New York State no longer allows a second building.
Why Main Street frontage? - Architect did frontage not Sitrin, they are meeting with the architect today to let him know they don't' want the Main Street frontage.
Oriskany Manufacturing - building permit application and plans will be put on hold.
Air Conditioner - two parts have been replaced - working good now. Trustee Bialek feels we need to get the other unit on the roof working; only one unit is working now. Trustee Jarosz will call Mr. Szeliga to look at it.
Vehicle log forms went out to each department involved.
Fixed Asset memo went out to each department.

Trustee Semeniak made a motion seconded by Trustee Jarosz to adjourn the regular meeting at 8:20 pm and enter into executive session to discuss two personnel matters, pending litigation, and labor negotiations.

Resolution 85-2008 -Trustee Semeniak made a motion seconded by Trustee Bialek to hire Amric Associates LTD to assist with a personnel matter.
Resolution 86-2008 - Trustee McCoy made a motion seconded by Trustee Jarosz to appoint Christina Kaczor to the Clerk's Assistant position pending the approval by Civil Service.
